Terms of Service

1. The Service

Aurvek is an AI infrastructure platform that provides:

• Access to conversational AI models from multiple providers (OpenAI, Anthropic, Google, xAI, and others).
• A marketplace where creators can publish, sell, and distribute AI-powered prompts and experiences.
• Tools for file processing, text-to-speech, image generation, and other AI capabilities.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One person or entity per account. Sharing accounts is not permitted.
• You must be at least 16 years old to use the Platform.
• We reserve the right to suspend or terminate accounts that violate these terms.

3. Payments and Billing

• Some features require a positive balance. You can add funds via Stripe.
• AI usage (tokens, image generation, TTS, etc.) is deducted from your balance at the rates displayed in the Platform.
• Marketplace purchases (prompts, packs) are one-time payments at the listed price.
• All payments are processed by Stripe. By making a payment, you also agree to Stripe's Terms of Service.
• Refunds: Refunds for marketplace purchases are handled on a case-by-case basis. Balance top-ups are non-refundable except where required by law.
• Chargebacks: Filing a fraudulent chargeback may result in access revocation and account suspension.

4. Creator Marketplace

If you create and sell prompts or packs on the Platform:

• You retain ownership of the content you create.
• You grant Aurvek a non-exclusive license to display, distribute, and promote your listings on the Platform.
• You are responsible for the accuracy of your listing descriptions.
• The platform charges a commission on sales (displayed during listing creation).
• Payouts are processed via Stripe Connect. Minimum payout threshold applies.
• You must not sell content that violates these terms or applicable law.

5. Acceptable Use

You agree not to:

• Use the Platform for any illegal purpose or to violate any laws.
• Generate, store, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to bypass rate limits, security measures, or access controls.
• Use automated tools (bots, scrapers) to access the Platform without authorization.
• Reverse engineer, decompile, or attempt to extract the source code of the Platform.
• Impersonate another person or entity.
• Use the AI models to generate content that violates the respective AI provider's usage policies.
• Resell or redistribute Platform access without authorization.

6. AI-Generated Content

• AI responses are generated by third-party models and may contain inaccuracies, biases, or errors.
• Aurvek does not guarantee the accuracy, completeness, or reliability of AI-generated content.
• You are responsible for reviewing and verifying any AI output before relying on it.
• AI-generated content should not be used as a substitute for professional advice (medical, legal, financial, etc.).

7. Intellectual Property

• The Platform, its design, code, and branding are owned by Aurvek.
• Content you create (conversations, uploaded files) remains yours.
• Content generated by AI models is subject to the respective provider's terms regarding output ownership.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Limitation of Liability

• The Platform is provided "as is" without warranties of any kind, express or implied.
• Aurvek is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not responsible for downtime, data loss, or service interruptions caused by third-party providers (AI services, payment processors, hosting infrastructure).

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may modify, suspend, or discontinue features with reasonable notice.
• Scheduled maintenance will be communicated in advance when possible.

11. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account for violations of these terms.
• Upon termination, your right to use the Platform ceases immediately.
• Provisions that by their nature should survive termination (liability, IP, dispute resolution) will survive.

12. Changes to These Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via the Platform or email.

13. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Barcelona, Spain.
